Tavares’ Tax Battle and Its Implications
As the Toronto Maple Leafs and John Tavares negotiate a new contract to keep him in Toronto, he may have managed to save several million dollars thanks to a recent court development. Tavares’ long-standing tax dispute with the Canada Revenue Agency (CRA) has been put on hold, and according to The Hockey News, the case is likely to remain inactive in a way that benefits him.
When Tavares signed his significant seven-year, $77 million free-agent contract with the Maple Leafs in 2018, it included a $15.25 million US signing bonus. The CRA argued that this bonus should be classified as salary and taxed at a 50% rate, which would amount to nearly $8 million Canadian. Tavares’ legal team disagreed, asserting that the bonus qualifies for a more favorable 15% tax rate under the Canada-U.S. Tax Treaty, which applies to non-residents earning income from services in Canada.
Impact on Canadian Sports Franchises
This legal battle has been closely monitored by all professional sports teams in Canada, including the seven NHL franchises, the Toronto Blue Jays, and the Toronto Raptors. The ability to offer large signing bonuses is a major advantage for Maple Leaf Sports & Entertainment (MLSE) when attracting elite talent. However, if the CRA were to prevail, it would make it much more challenging for MLSE and other Canadian teams to sign top athletes.
The CRA has previously targeted other Toronto sports stars, such as former Blue Jays players Josh Donaldson and Russell Martin, but lost those cases and is currently appealing those decisions. There is no update yet on whether the CRA will appeal the adjournment in Tavares’ case. For now, Tavares has emerged victorious and can move forward after an eight-year legal struggle.
Tavares’ Future with the Maple Leafs
With the tax issue temporarily resolved, Tavares can now focus on working out a new contract with the Maple Leafs. The expectation is for a three- to four-year deal, with an annual salary between $5 and $6 million.
Last season, Tavares recorded 38 goals and 36 assists for a total of 74 points in 78 games, making him one of the most attractive free agents this offseason. Despite his value, Tavares has repeatedly stated his desire to stay in Toronto and likely finish his career there. Reaching an agreement on salary and contract length should not be difficult for both parties.
Tavares will turn 35 at the start of next season, so a three- or four-year contract would see him playing until he is 38 or 39, unless he retires earlier. While age could become a factor later in the contract, he continues to perform at a high level for now.
